Privacy Policy

We have designed our privacy policy by establishing the appropriate means and procedures for the protection of our users’ data. We are aware of the importance that the use and handling of their personal information represents for our users and how we share it. Our commitment is to use this information with due care and prudence; however, it should be noted that no measure is perfect and invulnerable. This policy explains how we collect, use, and (under certain conditions) share information, applying to any natural or legal person using the Experiences, Application, and any service owned or controlled by SOUTHERN UNREALITY SpA. By using the Experiences, it is understood that the Privacy Policy expressed below has been read and accepted. Otherwise, we request refraining from using the Experiences and any information or service provided by it. Below, you can see in detail what information is collected through the Platform and its Services, how it is used, and what security measures have been adopted.

USER INFORMATION.
1.1. Registration on the Platform is voluntary. Each Registered User has their own Account and User Profile.

1.2. The requested information is intended for the identification of the User (name and surname, phone, address, email address) and personalization of their experience (photographs and presentations).

1.3. Experiences only have access to data voluntarily provided by the User.

1.4. The system collects, selects, and stores certain technical information about the User’s operating system, as well as statistical data, allowing for the improvement of services and user experience.

1.5. Since there is no direct physical interaction between SOUTHERN UNREALITY SpA and the data owner, the collection and processing of personal data are done on the presumption of good faith that the person providing them is of legal age, proficient in the Spanish language, in full possession of their mental faculties, has full legal capacity, and is the owner of the personal data or acts as a representative of the data owner who provides them.

1.6. This policy does not apply to information available through publicly accessible sources, including electronic, optical, and similar media designed to provide information to the public and open to general consultation, as well as any record or data classified or classifiable as public under the law.

USE OF INFORMATION.
2.1. The information, personal and non-personal data we collect and store are used for the following purposes: a) access and use of the Platform; b) identity verification; c) management, protection, improvement, and optimization of the Platform and its Services; d) creation and maintenance of a trustworthy environment in its use; and e) compliance with legal, judicial, or administrative obligations.

2.2. The information provided by users may be shared with related and/or associated companies of SOUTHERN UNREALITY SpA or service providers of SOUTHERN UNREALITY SpA. In this sense, personal data, as well as information generated from them, will be transferred to companies with which SOUTHERN UNREALITY SpA has a contractual relationship, provided with the aim of obtaining technical services, payment processing, knowledge of satisfaction levels, receipt of complaints, suggestions and claims, and other purposes already expressed in the previous point.

2.3. We may share aggregated information with third parties for market research or demographic profiling, identify trends, provide advertising, suggest connections, or improve our services.

2.4. We may share information about a User if required by law, by order of a court or administrative authority, or if we believe it is necessary to protect our interests or property, to prevent fraud or other illegal activities perpetrated through our Services or by the unauthorized use of our name.

2.5. As a result of the purposes described, data storage will be carried out indefinitely. For all purposes, it will be understood that this storage and processing time for personal data is a right of SOUTHERN UNREALITY SpA and not an obligation, so SOUTHERN UNREALITY SpA may choose to store and/or process them for shorter periods. This does not in any way affect the right of every User to request the deletion of their data, as detailed in this Privacy Policy.

2.6. The various uses described here, especially those related to payment processing, and updating and storing personal information, are expressly accepted by the User.

SECURITY RECOMMENDATIONS.
3.1. Do not reveal your Password or allow anyone to access your Account; this jeopardizes your personal information.

3.2. We recommend changing your Password frequently.

3.3. When using the Platform and its Services, assume that part of what you post will be accessible to other Users. We recommend thinking carefully about what type of information you want to share. Use discretion and common sense when disclosing personal information on the Platform.

3.4. Do not disclose sensitive information in your interactions, such as information about family or affective relationships.

3.5. The information you delete may remain in backups but will not be available to other Users. Even after deleting information from a Profile or Account, copies of that information may remain to the extent that it has been shared with others or copied and stored by other Users.

INFORMATION PROTECTION.
4.1. We use physical and technological mechanisms, as well as procedures and practices, to safeguard User information. We have implemented measures to protect and prevent the loss, alteration, and misuse of information under our control. These measures aim to safeguard the confidentiality of personal information.

4.2. Despite taking precautions, there is no platform, application, website, or service that is completely secure; therefore, we cannot guarantee that unauthorized access, hacking, information loss, or other types of violations will not occur in the future. We do not guarantee or respond to breaches by unauthorized third parties.

USER RIGHTS.
5.1. Data subjects may request at any time the modification, rectification, or deletion of their information through the mechanisms detailed below. The deletion request will be rejected in cases where the data subject has a legal, contractual, or commercial duty to remain in the Platform and its Services database.

5.2. To exercise their rights, the interested party must send an email to reclamos@outdoorclass.cl, providing relevant documentation. If we believe that more information from the data subject is required for the analysis of the request, we will communicate this situation. If 10 days pass from the request for new information without the data subject sending the required information, the request will be considered not submitted.

5.3. We may reject the processing of requests that are unreasonable, repetitive, or systematic, require a disproportionate technical effort, jeopardize the privacy of other Users, are considered impractical, or are contrary to law or good customs.

ACCEPTANCE AND VALIDITY.
6.1. For the purposes of this Privacy Policy, by the mere use of any of the Services provided by the Platform, and from the moment of use, any natural or legal person becomes a User, acknowledging and declaring that they have read, understood, and fully accepted this Privacy Policy, agreeing to be governed by each and every one of its terms, authorizing us to collect, store, use, and disclose their personal information in accordance with what is described here. Likewise, the use of the Services implies the full and unconditional acceptance by the User of the Terms and Conditions published on the Platform, which are complementary to this Privacy Policy.

6.2. We reserve the right to modify, correct, or change these policies; alterations will be published in this same space with their respective effective date. These modifications, corrections, or changes will be deemed accepted by the use made of the Experiences and their Services after they come into effect. In case of not accepting the changes made to this Privacy Policy, you must stop using the Platform and refrain from downloading or using any information, platform, application, or related software.

6.3. These policies are subject to and governed by the current laws of the Republic of Chile.

6.4. This policy was published and became effective on June 29, 2021.
